Judge dismisses most charges against NW pair accused of dog fighting

The trial of two Avra Valley residents accused of raising pit bulls that allegedly were sold in dog-fighting cirlces began Wednesday in Pima County Superior Court.

Judge John S. Leonardo will hear the case.

Pima County Sheriff’s deputies last February raided the west side home of Emily Elizabeth Dennis and Mahlon Thatcher Patrick, both 63. There investigators say the pair ran a dog-breeding operation that specialized in pit bulls.

At least 110 dogs were confiscated from kennels at the property. The Pima County Animal Center later put down most of the dogs.

On Thursday, the second day of the trial, Judge Leonard agreed to a motion made by Deputy Pima County Attorney Lewis Brandes to dismiss 21 misdemeanor charges of cruelty to animals against Dennis and Patrick.

The pair now face two counts each of felony dog fighting.

Dennis and Patrick earlier had waived their right to a jury trial.

This is such BS - why are the dogs killed before it is even decided if anything wrong is going on? In the Vick and Stoddard, MO cases, the dogs were all held until the verdict was reached.

Veterinarian on stand in dogfighting trial

A veterinarian took the stand Wednesday in a dogfighting trial in Tucson.

Last February, Pima County Sheriff's deputies seized 150 dogs from four properties.

Investigators say the suspects bred dogs for fighting.

Maylon Patrick and Emily Dennis are on trial for their alleged part in the operation.

They each face two counts of dog fighting.

The two sat in court Wednesday, taking notes.

A veterinarian the defense asked to examine the dogs after deputies seized the animals, took the stand.

Dr. Barry Wilkinson repeatedly testified that it was difficult to tell how the dogs got their wounds.

"It could have been due to an infection in the skin, uh, an abrasion rubbing on something. It could be a healing bite wound. It could be any one of a number of causes."

Prosecutors say none of the dogs seized from the suspects' property was socialized, and they weren't pets.

They say the couple's own online ads will prove they bred dogs for fighting.

Ya know what trips me out is that if you watch the video the first thing that comes up is RAGE IN THE CAGE. Its FUED up that Dogs have more rights than humans. If a dog wants to play in the fun box its all so TABOO and your ass will go to Jail. BUT WE all pay big bucks AND BET on the two guys and girls that beat each other up. I am Joe woodall On October the 28 th the hsus,aspca , lead by John"jp"Goddwin, lead fannin county da Office and gilmer County Sherffies office on a raid of our home, where they found nothing wrong,found no eveidence of no wrong doings but still took all 13 of my dogs,one was our sons dog Purdy which stayed in our home,we have veido taped these dogs for over 2 years, i veido two days before the raid, and the raid, we have vieod taped the gilmer county animal shelter it was awfull, some dogs were laying in there own feices,i saw no water or food for the aniamls the water that was in there were black, as of today 11/19/08 they still have not chrged me with anything,but I dont know if my dogs are alive or dead,On the same day the raided Ray beaver home in gilmer county, takne all his dogs because he had a saw with altered serial #'s They ahve killed all his dogs,also they raided Randall Thaxton home takne his dogs all they found on his property was a tread mill,Randall goes to weight pull,treadmill races and he loves the treadmill races,the private investagator on this is Chuck Simmons, he was at the last comformation show In feburay 2008 where our son Kyle Woodall Won first place with his dog Skiny, Skiny did not like the treadmill race so he lost that, but was the best looking dog in his class,Chuck Simmons works along with the Norrad and acc. ran by Greg Norrad,We have done nothing wrong, I had no idea who John Goodwin was when he raided our home, but now I do, Him And I had words,now if I had only knew who he was I would have charges on me for slapping his teeth out!!!!

so what are you saying that dogfighting should be ok because if you think that your sick man dogs are our pets why force them to fight they were bred to fight hundreds of years ago thats over with now they will be our pets we will love them like they love us

I dont know who you are and I dont undestand what you are saying, I think it is wrong to let dogs fight,I think It is wrong that you cowards can come take our property for no reason
I never said I fight them and never said I agreeded with it I stated that they have taken my dogs for NO REASON, I have not been Charged with anything and they have my dogs and if they havent arleady they may KILL them, I can see by what you wrote you dont love the APBT,Like I do. I do Belive in my constitional rights,I do belive in your constitional rights also,just like our forefathers I will fight for our rights!!! If that is a box of rocks just call me rocky!!

Ps. People stand up and stop these cowards from taken our rights, that our fore fathers fought and died for!!
