Animal control....again (yes mad)

    So, I get a message from my wife while I was at work that when she got home there were 2 citations for animal cruelty on our door.
    *no water
    *no food
    *no rabies vacc
    *not registered
    *not allowed to tether unaltered dogs

    I have 2 outside dogs....or did have I should say. 5 gallon buckets of water and food trays in their spot (they get fed 1x/day at night. I have/had a female that needed her bucket refilled 2-3x/day because she dumps it. It just so happened that it was dumped when they came out. So, he fills the bucket with water and gives it to the dog that already has a bucket full of water. Never mind the kiddie pool that is between the dogs I put out there for them because of the temperature. I'll take the hit on the rabies and registration because I try to get the 3yr vacc and haven't been able to make it to the vet and I don't register anything with the city (hardly animal cruelty). I checked the laws a couple years ago about tethering and rechecked as soon as I got home. It says nothing about tethering unaltered dogs.

    Anyway, I have 24hrs to comply or the dogs will be taken. I tried calling the officer and he was supposed to call me back:rolleyes:. Never happened. It just so happens my vet is closed Wednesdays for surgeries. The dogs are gone now. We know our neighbors and are pretty sure they didn't call. Regardless, problem solved.

    They came out years ago for no water and no food but wrote a statement they did not approach the dogs. I took the citation and walked straight to the buckets and they were filled to the top with clear cold water. :mad: AC, can't live with them, can't afford the lime....

    AC is a frustrating branch to deal with in some places. it's like talking to a child. no matter what the explanation is they don't want to hear it. they do not approach each complaint filed in a case by case basis, it's generalized. in my experience,

    Anything about you that can be observed in "plain sight" from the street or sidewalk can become probably cause for a warrant. Even areas on your property open to visitors can be dangerous.

    i left one dog untethered for 45 min. moving was the only option after showing them everything they asked for and their response was you have 48hrs to remove the animals. no point getting angry, stay calm and methodical. the law is based on presumption and the key is making the plaintiff prove their complaint. after "problem solved" i would get the proof of rabbies vac asap. good luck.

    I no longer have the dogs. It's hard to give a rabies vac when I have nothing to give it to.
    Lesson learned. Only keep children chained outside. It's less cruel.

  9. Sucks man. You have to be a lot more diligent with your hounds nowadays. I also hope your right about your neighbors if you want dogs in the future. Seems to me, someone had to tip them?

    I asked the officer what prompted the check-up and he said someone called and said they didn't have water. He then gave a quick run down of what he cited me for and I corrected him about the tethering. I said, ''I checked the law a couple of years ago and then again last night and it said nothing about whether or not an unaltered dog can be tethered.'' His reply, ''You must have looked at an old ordinance because we have a new one.'' Nevermind the fact that I checked it on the city's official ordinance page. At that point, I just wanted him gone. Just the smug look on his face was deserving of a kick to the nuts. Anyway, like I mentioned the dogs are gone and everything is good.

    In case people didn't read above, the dogs had water and a kiddie pool.

    you can also add a fee schedule to that sign, that means fines. yes, it is legal and binding in civil courts. not only are you not responsible to injuries and such but they will have to pay YOU fines posted. "authorities" included. the law can be fun :)

    i forgot to mention, you do have to file all this with your county court with an affidavit and letter of intent. send certified copies to all parties, AC, sheriff, D.A., etc...

    when you know the law and they know it, they tend to not fuck with you about stupid shit.

    Thanks Jim, Yeah they really hate it when you know their laws and your rights, and how to use them for your well being. Go citizen.! I think it is best to read up and know your local laws, things could get real sketchy in the near future and it is best to have your ass covered, not just the dogs but water rights, lumber, land etc. depending on where you live. The thieves are going to be looking for other ways into your pockets, let them know you are onto them. lol Many times law enforcement,AC etc. do not think these signs(keep out, no trespassing) pertain to them as well, they place themselves above your rights, good to let them know how it REALLY is. Be forewarned though they do not like this and you may very well be targeted and harassed even labeled terrorist or something of the like.

    no problemo meng. don't mind sharing what i've learned. if that happens, take it to a higher court and/or grand jury with harassment complaints on "they". do it "legit" like they like to call it. civil laws and ordinances are basically contract and trust laws. there are three "parties" in trust law; executor, beneficiary and trustee. if you don' you know the law, you will ALWAYS be the trustee. if you know your shit you ARE the executor. it has nothing to do with "rights", that's for tustees. executors MAKE the rules.

    it can be confusing at first since everyone is conditioned. know the law!

    think about this. when a "defendant"(trustee) goes to court or hearing. why is that party the only one that does NOT get paid?? the hiring of an attorney, lawyer or esquire is the worst thing you can do. they have an oath to the bench. it's hard to explain.
