    It has come to our attention that the property rights of APBT owners in the state of Georgia are being steamrolled over by Humane Society of the United States (HSUS), American Society for the Prevention of Cruelty to Animals (ASPCA) and the private investigation organization Norred and Associates.

    Our concern is that due process is being bypassed and the need to ensure that there is a real basis for the seizure of animals and to hold the impounding agency responsible for the costs of impoundment where there was not a reasonable basis for the impoundment. The biggest Constitutional problem is the potential loss of property by someone who is not charged or convicted of a crime, whether or not there was probable cause.     Although not controlling, this is similar to the substantive due process violation found by the District Court in the Louisville case. They found that pet owners have a clear property interest in their pets. The question was the extent of the process that is due before depriving a person of their property. In the Louisville case, the court held that a court's determination that there was probable cause was insufficient to provide a basis for the loss of the property rights.

    It is also our concern that the existence of probable cause alone does not permit the government (or a private party authorized to act in a governmental capacity) to confiscate the property of someone who is not guilty of a crime, especially when onerous costs may be imposed to retain their rightful ownership.

    These three private corporations are deeply involved in law enforcement activities in the State of Georgia. These three private corporations appear to exercise a leadership role in investigations and prosecutions of Georgia residents, taking over the function of public law enforcement agencies and individuals responsible to the public and open to public scrutiny.

    We question how the employees of private corporations, who answer only to their own boards of directors, are able to exercise such influence and interfere in the responsibilities and functions of Georgia public servants.

    Please join us in calling for a thorough investigation of the activities of HSUS, ASPCA and Norred and Associates in Georgia law enforcement by writing a letter to Georgia Governor Sonny Purdue and Georgia Attorney General Thurbert Baker.

    Points to include in your letter:

    Improper and undue influence of private corporations in Georgia law enforcement

    · The Humane Society of the United States (HSUS) is a private not-for-profit with over $200 million in assets and $100 million in annual income. Despite its name, HSUS does not operate a single shelter for pet animals, and cannot function in a law enforcement capacity anywhere in the United States.

    Also on February 16th of this year in a RICO (Racketeer Influenced and Organizations Act) lawsuit was brought by Ringling Brothers Circus owned by Fled Entertainment, leveling bribery, fraud, obstruction of justice, and money laundering charges against HSUS and two of its corporate attorneys, along with other AR organizations.

    This lawsuit was in response to a ruling on Dec. 30th 2009 by Federal Judge Emmitt Sullivan that these defendants collaborated to pay more than $190,000 to Mr. Tom Rider, a former Feld employee who was an elephant “barn helper” for two years in the late 1990s, in exchange for his impeached testimony against Feld in an earlier lawsuit—testimony Judge Sullivan declared “not credible” and disregarded in its entirety.     · The ASPCA, another private not-for-profit corporation, has no law enforcement jurisdiction outside of New York City.

    · Norred and Associates is a private, for profit, investigations company with no authority and no legal enforcement function whatsoever.

    Abuse of public funds

    · For a substantial fee, HSUS’s “Humane Society University” offers training courses for the elected officials responsible for representing the interests of the people of the State of Georgia and other jurisdictions.

    · In coordination with the ASPCA, HSUS offers a “How to Prosecute Animal Cruelty in Georgia” booklet to public employees in the State of Georgia.

    · The training of law enforcement personnel is properly accomplished by agencies and individuals responsible to the public. It is inappropriate for private not-for-profit corporations, who answer only to their own board of directors, to influence and interfere in the training of public servants and to usurp their professional functions. Employees of the not-for-profit HSUS and the ASPCA have no public accountability, nor do the employees of Norred and Associates.

    · As a Georgia resident, voter and taxpayer, I do not support the expenditure of public funds on such questionable programs, products and procedures.

    · The training of law enforcement personnel is properly accomplished by agencies and individuals responsible to the public and, ultimately, to the Governor of the State of Georgia. It is inappropriate for private not-for-profit corporations, who answer only to their own boards of directors, to influence and interfere in the training of public servants and to usurp their professional functions. Employees of the not-for-profit HSUS and the ASPCA have no public accountability, nor do the employees of Norred and Associates.

    This is what changes are needed:


    • Requiring impounding organizations to be responsible for the legitimacy of their seizures.


    • Oversight to ensure that impoundment charges are reasonable and only applicable if the person is found guilty.


    • That only animal control officers will be able to enforce animal control laws.

    Request for investigation


    • The Governor or Attorney General of the State of Georgia should implement an immediate and thorough investigation into the undue and corrupt influence of these private corporations in law enforcement training and procedures.


    • The citizens of Georgia cannot continue to be victimized by privately employed individuals operating in the public sector with the assistance and blind support of law enforcement and prosecutors throughout the state.


    • Fair and lawful enforcement of Georgia statutes is the responsibility and exclusive domain of our public servants.

    Everyone from Georgia needs to read this and make an attempt to write a letter to these representatives regarding this issue. You could be next! These organizations need to be stopped and the use of these organizations by our governmental agencies needs to be stopped. Your own tax dollars are being used to unconstitutionally destroy people's property without due process! Stand up and do something.

    Also, If you write them, please be respectful, use spellcheck, etc.
