It should be noted that HB 2116 has the same language regarding breeders as HB 1451, and “prohibits an owner from leaving a dog outside unattended in a restraint” “Restraint” means a chain, rope, tether, leash, cable, or other device that attaches a dog to a stationary object or trolley system. Added by Acts 2007, 80th Leg., R.S., Ch. 674, Sec. 1, eff. September 1, 2007.
Which means we would not be able to house our dogs on chain setups. Contact your local State Rep., by email, letter, or leave a voice message vehemently opposing HB 2116.

Click here and type in your address to find the name and contact information for your State Representative. http://www.house.state.tx.us/resources/frequently-asked-questions/#who_rep

You can email Rep. David Simpson (David.Simpson@house.state.tx.us),and thank him for shooting down HB 1451.

HB 2116 also bans all kennels that are less than 150 sqft. It was reported that Rep. David Simpson would filibuster HB 1451 by Rep. Thompson so she pulled it from the calendar, but it is now being reported that it is back on the calendar. So please ask your State Representative to oppose HB 1451 also.

  4. Some of you fellow Texas dogmen and women need to contact your representatives and urge them to strike this bill down, and send a message to animal rights activists that we will not put up with them trying to impose their views on us.

HB 1451 was struck down in Local and Consent calendars and placed on the Major State calendar (4/26/2011) to go to the house floor for a vote. When HB 1451 author and Local and Consent Chairwoman Rep Thompson asked Rep. David Simpson if he was prepared to talk for 10 minutes (to filibuster HB 1451) and he said "10 minutes or longer!" Once again call and thank Rep. David Simpson. Phone: (512) 463-0750 Fax: (512) 463-9085 EMail:david.simpson@house.state.tx.us .

Just like we are thanking him, the other side is ATTACKING him. The humaniacs took out a full page ad in his district's local newspaper attacking Rep. Simpson. It is important that he knows he is supported in his actions of protecting our freedoms.

The fight is not over we cant jump the wall now, PLEASE You can find your representatives and senators
at: http://www.fyi.legis.state.tx.us/ Tell them to kill HB 1451 and HB
    2116 (the shorter version)!

They claim it is a way to stop puppy mills, and a preventative measure to keep animal cruelty cases from happening. Instead of increasing the Texas animal cruelty law to help punish those that are found guilty of animal abuse, they want anyone who owns 11 intact females to be regarded as a commercial breeder; to be governed and licensed by the State. Once again instead of punishing the wrongdoers they want to impose government control and legislation on everyone. If those deemed commercial breeders do any part of their breeding at their home, then their home is seen as a breeding "facility", according to the actual bill below:

    Sec.
    A802.063.AAINSPECTIONS. (a) The department shall
inspect each facility of a licensed commercial breeder at least

once in every 12-month period and at other times as necessary to
ensure compliance with this chapter and rules adopted under this

    chapter...

(c)The department or third-party inspector may not provide

advance notice to the commercial breeder or a representative of the

commercial breeder before arriving at the facility. The commercial
breeder or its representative shall, on request of an inspector,

assist the inspector in performing the inspection.

Which is in violation of the 4th Amendment to the U.S. Constitution, the part of the Bill of Rights that guards against unreasonable searches and seizures and requires a judicially sanctioned warrant supported by probable cause.
