Aurora's pit-bull ban wins 2nd round

    Denver,CO -- The Colorado Court of Appeals has upheld the dismissal of a lawsuit against the city of Aurora over its pit-bull ban.

    Brighton resident Khristina Villani, who owns property in Aurora, brought the suit against the city in Arapahoe County District Court, saying that her constitutional rights were violated by the ban.

    Villani, who represented herself, had asked for the appeal after a judge dismissed the case because the court did not receive a response she was later found to have sent. The dismissal was promptly vacated.

    But in the end, the Court of Appeals found Thursday that she did not prove her case.

    Villani could not be reached for comment Friday.

    The Aurora City Council imposed the ban on new pit bulls in February 2006. But it did allow all current owners at that time to keep their dogs if they obtained $200 annual licenses and adhered to a number of requirements.

    Those requirements included implanting the dogs with a chip allowing them to be identified, providing the dogs with secured backyard enclosures and posting warning signs on front doors.

    Denver also has a pit-bull ban, and has come out on top when residents have tried to challenge it in civil court.

    Its too bad she didn't find a decent lawyer to represent her. There is an old saying, "the person who represents himself has a fool for a client".

    There are 3 lawsuits against the city of Aurora, 2 at the district, the one this article refers to had been dismissed at the district court level, so it was appealed, and then the court of appeals dismissed it so now it will be appealed to the Colorado Supreme Court. There was a lawyer retained IF the courts would hear the case.

    The lawsuit at the federal level is moving forward and in discovery.
