    Pit bull released and reunited with his family

    COLORADO SPRINGS -After spending six months in doggy prison a local family's pet wins his freedom in court and is reunited with loved ones.

    It all started last July when David Payne was walking his two pit bull mix dogs on a leash when a much smaller dog, not on a leash, ran up and a fight broke out.

    The smaller dog was killed and Payne's dogs were taken. The owner had to pay 600 dollars per dog for the humane society to hold them, money he just didn't have.

    He eventually had to choose. One was saved, the other was put down, just days after missing the payment, but Wednesday's court ruling said it never should have escalated to that point.

    For the Payne family the past 6 months have been a nightmare, but after the jury ruled in their family they were finally ready to go pick up their dog "Buddah."

    They were, anxious, nervous, and excited as they waited at the humane society. Eventually the door opened and Buddah came running out.

    "Buddah come here boy. That's my Buddah boy," said Payne

    It was a reunion Payne said was long overdue.

    "I'm pretty sure he's ecstatic to be out and I'm ecstatic to see him. We had our little pleasantries if you can call it that," said Payne.

    But getting to that point wasn't easy.

    Before Buddah could be set free a jury had to decide who was at fault and they heard two very different stories.

    Payne's attorney said it was the dog off the leash that started the fight, but that dog's owner said it was Payne's pit bulls that went on the attack. In the end, Payne won.

    "Someone should not be held at fault when they're walking their dogs on leash. Even if it's a smaller dog walking without a leash and loses the fight," said Juliet Piccone.

    But as happy as the reunion was there was something missing and that's his other dog Chleo.

    "Ultimately Chleo was was found not guilty in court today but she was not there, she did not have the chance to stand trial because I didn't have the money," said Payne.

    It's something Piccone said has to change.

    "Its generally $600 a month and its always prepaid. You should not force a person to have to pay that until proven guilty," said Piccone.

    She plans to bring that argument up with lawmakers, in hopes of getting the laws changed or at least tweaked.

    Meanwhile, Payne is just excited to have one of his family members back.

    "My girls are excited to be with him, I'm excited to be with him. We're going to go for a walk and celebrate him being a live," said Payne.

    Not only did the humane society release Buddah back to his family, they also had to cut them a fat check. They reimbursed Payne the $3000 he paid to keep his dog there for six months.
