OH: Tiffin Considers Dangerous Dog Law

    Council to consider dog law

    An ordinance to set laws for dangerous and vicious dogs in Tiffin is to go before City Council at its next meeting.

    During a meeting of the Tiffin City Council Law and Community Planning Committee, a draft of the proposed legislation was discussed and agreed upon to move before the board. The legislation lists criteria necessary to label a dog as dangerous or vicious, restrictions upon labeled dogs and states violators are guilty of a first-degree misdemeanor.

    According to the legislation, a "dangerous dog" is a dog that, without provocation, has chased or approached in either a menacing fashion or an apparent attitude of attack, attempted to bite or otherwise endanger any person while off the premises and not under the control of its owner, keeper or harborer.

    A "vicious dog" is a dog that, without provocation, has killed or caused serious injury to a person, caused injury to a person or killed a dog, or attacked and caused serious injury to another dog, domestic animal or feline at least twice.

    Dogs deemed dangerous must be securely contained by a tether or a leash and vicious dogs contained in a locked fence with a top when outdoors, according to Ohio Revised Code, and signage must be posted. In addition, the dog must wear a muzzle and be on a chain- link leash of no more than 6 feet when off the premises.

    The new legislation does not include any breed-specific language, although the Ohio Revised Code lists dogs commonly referred to as pit bull dogs as vicious, and the containment laws would apply for those dogs regardless of past behavior.

    The legislation does not apply to police dogs who have attacked while assisting law enforcement officers or to dogs who have attacked a person committing trespass or other criminal offense on the property of the owner, keeper or harborer.

    Mayor Jim Boroff asked how the law would be enforced.

    Police Chief Dave LaGrange said information about residents with dangerous or vicious dogs could be added to the police database, which would alert officers of violations.

    Committee members discussed awareness through public posting and the possibility of having letters attached to applications for dog licenses from the Seneca County Dog Warden.

    The legislation is to go before council at its next meeting, 7:45 p.m. Oct. 4.

    It was a result of a request from resident Andrea Robinson, whose dog was attacked. Robinson, who was at the meeting, thanked the committee for its work.
