NC Animal Protection Bills HB 2098/ SB 1554

Discussion in 'Laws & Legislation' started by RIVES PITS, Jun 26, 2006.

North Carolina's unique civil remedy law which allows third parties to file suit alleging animal cruelty is being revised this year. If these bills pass, animals may be seized, vetted and relocated prior to trial. The assumption of guilt before innocence conflicts with your right to due process. (Basically if your show dogs are seized, they could be spayed/neutered and placed before you are even proven not guilty)

The bill has been steered through the NC General Statutes Commission for introduction to the General Assembly by Professor Bill Reppy, Duke Animal Law, a member of the committee. Professor Reppy is a long time animal rights activist and current member of ALDF.

The bills have passed in committee. The NCRAOA web page
http://www.ncraoa.com/AlertHB2098.html has been updated with a pre-addressed email to all sponsors/co-sponsors of the bill and links to the House and Senate member lists.

Send your vote today to oppose.

PLEASE DON'T THINK EVERYONE ELSE IS GONNA DO IT SO YOU WON'T HAVE TO IT WILL ONLY TAKE A FEW MINUTES AND IT WILL BENEFIT ALL APBT OWNERS HERE IN NC.

Everyone needs to sign this, its clearly unconstitutional taking away our right to due process. "Guily until proven innocent" is the new policy now-days I suppose.

To make it abit easier on everyone, simply add this: "rickg@ncleg.net,earlj@ncleg.net,paull@ncleg.net,jenniferw@ncleg.net,larryw@ncleg.net"
to your list of e-mail recepients, type something refering to the specific bills in the subject and a brief reason you either support/do not support the bill below. We do not all need to write essays, a small paragraph should do. Its important we flood their mailboxes with those who do not agree with the law so they can understand the A.R.A. arent the only ones who come out in large numbers to support something. I give no hint to the fact I am not from NC, I dont recommend other out-of-state senders do either. These people are representing the people who vote for them, and if they believe we will be voting for them next season, they will listen to us for those votes! Try to be polite and respectful, no name-calling, etc.

The short letter I wrote is posted below, so if you are undecided on what to write, this may give you a few ideas of directions to go.

"I am writing this letter to give my opinions on both of these bills. To me, it is unconstitutional to overturn the right to due process. "Guilty unless you can prove your innocence" is not what this country was founded on. I myself raise show dogs, and have never bred a litter in my life, and doubtful I ever will. However, with these new laws my dogs could be seized, neutered/spayed, and adopted before I even am found innocent. Even if I was to get my animals back, they would be worthless show animals (you cannot show an altered dog). My dogs are pets first and foremost, however getting out and going to shows is a great deal of excitement for them, and they anticipate the festivities from the time we start working to put them in shape for the show. I fear if something was to happen to where they can no longer compete in good-nature, they will be lacking an essential part of their lives. Thank you for taking the time to listen to the ones your representing, and I urge you to remember the right to due process before reading this bill one more time. I'm convinced most anyone can see what this bill would be doing is essentially-illegal, and if need be we will fight this in court to see our rights are not taken away. I understand this takes alot of money from both sides, and I would hope we can all be reasonable and simply vote this unconstitutional bill down today. Thank you Senator."

I greatly appreciate the support of anyone who is willing to take a few minutes to post the addresses and write a quick summary of their opinions on the matter, and to show my appreciation anyone who posts that they have sent out a letter to each Senator, will receive rep points from me. I'm going on an honesty system that everyone who posts that they did write a letter, actually did...so please dont let me down folks.
