LA-Boudreaux Family Sues LA SPCA

    I was told by Laura Maloney that the reason why they had to be euthanized is it is Louisanna Law that the dogs are considered contraband. I am not sure how true it is but if it is Lousianna law needs to be changed.

    I met her at a Vet conference earlier this year.

    (2) The legislature finds and declares that fighting dogs used or employed in violation of R.S. 14:102.5 are dangerous, vicious, and a threat to the health and safety of the public. Therefore, fighting dogs seized in accordance with this Section are declared to be contraband and, notwithstanding R.S. 14:102.1, officer may cause them to be humanely euthanized as soon as possible by a licensed veterinarian or a qualified technician and shall not be civilly or criminally liable for so doing. Fighting dogs not destroyed immediately shall be disposed of in accordance with R.S. 14:102.2. - LA State Animal "


    "fighting dogs used or employed in violation of R.S. 14:102.5 are dangerous, vicious, and a threat to the health and safety of the public.     This is an example of a guilty-until-proven-innocent law.


    As it turns out, the Boudreaux dogs were not "fighting dogs". . . yet they were dead before Floyd and Guy Boudreaux were even arraigned on charges. A sequence of events which completely, totally, insanely, stripped the Boudreaux of their due process rights.

    Boudreauxs to Sue SPCA

    After being acquitted of dog fighting charges one year ago, an Acadiana father and son are suing the Louisiana SPCA for killing 57 of their dogs and destroying their life's work.

    Four years after being arrested and acquitted of dog fighting charges Floyd Boudreaux is speaking out. He is suing the LSPCA after claims they wrongfully euthanized his pit bulls.

    According to Louisiana statue there is a proceeding that would have allowed the Boudreaux's to bond out of jail and save the dogs. But, their attorney says that time was never there. News that allegedly took so hard to Boudreaux, it led to a heart attack.

    According to the suit damages ranging from three hundred to half a million dollars could be awarded to Floyd and his son. But according to them, it no where near replaces the act of having to tell his ten year old grandson he'll never see his pet again.

    The SPCA denied comment until they are legally served the lawsuit. However a trial date for the case could be set anywhere between nine and twelve months from now.

  11. That makes me want to cry. How did these poor dogs go from being a symbol of America to be allowed to die of heat stroke in a hot car in the hands of the LAW. These are the people who make a career of supposedly preventing animal cruelty and championing the cause of good care.... and they can get away without jail time for doing something like that? Any normal citizen would have to answer legally for that.

    I wish the Boudreaux family the very best of luck,but like Woody said it's a lifetime of work ruined,and I'm sure it was an unbelievable amount of stress on a harmless old man.I hope he gets an enormous settlement,I hope PP follows up with another lawsuit of his own and I hope anyone else that's been railroaded by the SPCA sues too.Go get 'em FB!!!

    300 to half a million , goes no where near compensating a life times work, three hundred million would be more like it, but still no amount of money can fix this

    I wish them all they deserve and more. And the previous poster is right. Had it been a private citizen hauling dogs that way, they would still be in jail. Not only did Floyd and Guy and their family suffer, but the dogs did as well.
