    Certificate of Sale



    This sales contract is made this __________ day of ___________ year ______________ between …………. and ................... Hereinafter referred to as the sellers and, ______________________________________________________________________
    ______________________________________________________________________

    hereinafter referred to as the buyer.



    The sellers agree to sell and hereby do sell a American Pit Bull Terrier of

    _____ female _____ male sex, whelped on ____________ litter

    reg._______________ and sired by________________________________

    ADBA Reg.____________________

    out of_____________________________________

    ADBA Reg____________________

    for the sum of ________ paid in full on_______________.



    Sellers certify that this dog is of sound body and temperament, and in good health and free of communicable diseases to all outward appearances. Sellers will provide health records regarding the then current status of veterinary care, vaccinations and worming at the time of delivery of the dog.



    Sellers will provide a five generation pedigree and ADBA registration application or proof of pending litter registration as part of the purchase price.



    The sellers certify that, to the best of their knowledge, this dog is free from all hereditary disabling diseases and agree to replace this dog upon return of the dog, if a hereditary disabling or terminal disease appeared within one year of date of sale. Such condition shall be certified by both the seller's and the buyer's veterinarian.



    The sellers shall retain the option of registering the dog under their kennel prefix ( ).



    Buyer certifies that this dog will not be used in any form of inhumane treatment of itself or any other animal, including dog fighting, pitting, or rolling, or breeding or training for these purposes, or any other illegal activities of this sort. If convicted in a court of law for activities of this sort, this sales contract becomes null and void, and buyer will return the above described dog to sellers. Buyer will forfeit any and all monies paid to sellers for this dog.



    If buyer becomes unable to keep this dog, he/she will contact the breeders. The breeder retains the right to purchase or will assist buyer in finding a new home for the dog.

    Might you sale a dog it should be smart to work with contracts such as the example listed above.
    It's made up for your own safety and to let the deal run smoothly in favour of the animal and both participants.

    Why is it that anyone would need a contract to sell a dog that is encroaching on what the buyer is doing with said product?

    I mean unless you are selling animals for the sole purpose of your buyers to break the law, you should be legally exempt from anything the buyer does with said product once it leaves your possession, right?

    I'm asking because I do not sell dogs. I just do not see how any breeder can be held liable for anything a buyer does unless like I said they're selling dogs for illegal activities.

    As a seller you can not control anything the buyer does once the product leaves your hands, period.

    Also, more times than not, those contracts are worthless pieces of paper in a court of law unless drawn up at a law firm and notarized. I use to use them years ago but haven't in well over a decade. Im not home currently but when I get back there I will post another example of one for anyone interested in using them.

    In theory it's showing that the buyer will not abuse, fight or do anything illegal with the dog. However, people will always tell you what you want to hear and in the end do what they going to do and most homemade type contracts won't hold up in court.

    Another example of a sales agreement or contract. This is the one I use myself. Or, well, did use back in the late 90's early 2000's. Been a pretty long time since I used them. I literally had to dig these out of 2 decades of paperwork in my filing cabinet lol.

    Basically to protect the breeder from, say, someone who takes the pup, ends up using the dog in illegal activities, gets busted and trys to flip on the person who sold them the dog saying they bought a fighting dog from so and so. It shows they signed a contract when buying the pup to the contrary. Relinquish liability of the breeder. Like I said before though, most of these will not hold up in court unless signed in front of a notary. However, it would show, to a court, that you attempted to minimize the chance of said dog being used in illegal events which could still help show the breeder was not selling the dogs for that reason.

    AGK I get it but...
    No one can control what someone else does.
    The breeder/Seller should never be held liable for something they have zero control over period.

    I've never used on in with bulldogs but when we had Fila Brasileiros it was an absolute part of every deal. Most stretched out to to 28 months for hip and elbow x-rays.

    I like the phrase in AGK's 'will refund money' as most do not refund, they replace with another puppy. That part sucks because it may be sometime before the next breeding and the breeder has your money. "Will refund money" shows full confidence is what is being sold, That is a good thing.

    I agree that it should protect both parties going forward but in today's world where you can sue/indict a ham sandwich for nay and everything, I doubt one would hold much weight in court. Especially on a bulldog witch hunt. But those are the times.
