Ohio BSL pending............
This is just too scary.......
Before the State Legislature RIGHT NOW in the state of Ohio:
HB 568 unacceptably provides that:
* No person shall own, keep, or harbor a dog that belongs to a
breed that is commonly known as a pit bull dog.
* No later than 90 days after the effective date of this bill, a
person who owns, keeps, or harbor a pit bull dog will be forced to
surrender the dog to a dog warden.
* Within ten days of surrender, the dog warden shall euthanize the dog.
* If an officer has probable cause to believe that a dog is a pit
bull, the officer may apply for a search warrant. After obtaining a
search warrant, an officer shall seize the dog and transfer the dog to
the dog warden, who shall euthanize the dog within 10 days.

All concerned Ohio dog owners should contact their elected
representatives and express their strong opposition to HB 568. To find

I copied this from another forum. After reading through some of the info on ARC's website I am fuming, I had no idea that BSL was so extensive! I hate it when laws are made out of fear and in todays world fear seems to be everywhere... fear of global warming, fear of someone buying a vehicle that is too large, fear of cow farts, fear of guns, etc!! I have worked around animals my whole life and any dog of any age, breed, color or sex is capable of biting just as it is of rolling over for a belly rub!
So I guess if this passes it will be illegal to own a APBT anywhere in the state of Ohio after 90 days. They will round up, sieze and kill anything that the dog warden deems a APBT! Bullhockey!! What breeds are next OEB's, Rotts, GSD's? I have a scar on my hand from a Doxie that was the worst bite I have ever received from a dog... bet they won't be on any BSL list!!
Sorry for the rant but I am about sick of a few people telling me what I can and cannot own. Did I wake up in a socialist country!!

scary they try and pass OH HB 366 which removes "pit bull" from the dangerous dog law, now some shit stick tries to squeeze this through....

this is an under-handed move in my opinion.
the bill has two parts.
part one is identical to OH HB 366, which removes the term "pit bull" (which we all know is not an actual breed of dog) from the dangerous dog law in OH, but this one tacks on what was posted at the end, to seize and destroy all "pit bulls."

edit - i just spent about half an hour on the phone w/ rep. fessler (state rep for my district). i spoke w/ her and rep. webster who started pushing oh hb 366. in a nut shell, although they agreed it was wrong (oh hb 568), they said not to worry too much. he's a dem in a republican controlled house. they didn't see it being an issue. they spoke about the hearings for oh hb 366, and said after that, a lot of folks in the house had changed their previous opinions of the breed, realizing how much of the things they read and saw in the media were incorrect.
they are in session two more weeks, then break for the summer. they said there's more hearings scheduled for oh hb 366 in the early fall, and it should get pushed for voting by fall this year.
i had originally called rep. yates' office, and his aids didn't seem to like what i had to say on the phone, and he was "out of the office." when i was on the phone with rep. fessler, first we had a 3-way call w/ rep. webster, then she had her aid get rep. yates' office on the phone. when she spoke with the peon that answered, low-and-behold, he said "rep. yates is right here if you'd like to speak with him rep. fessler." she actually got him on the phone and started to tell him how her phone had been ringing this morning about his bill. then she let him know i was on the line, and that i was the young fellow who had tried to reach him only minutes earlier.
i asked him to explain his logic behind the bill. it was flawed, i pointed out several reasons why, and rep. fessler said she agreed with me based on the truths she learned about the breed at the hearings for oh hb 366. these myths about the breed were behind his reasoning. needless to say he wasn't happy, and ended the conversation abruptly with "i have to get to committee. thanks for your concern, and have a good day." *click*
just nice to know that some of these folks we vote for take the time to listen to you and see what you gotta say.
i suggest any ohioan to call their rep and voice concern over this.

any and all fellow ohioans please let our voices be heard , there is also a petition a local bsl group has started. It has gotten worse Sec. 955.111 gives any officer the right to determine what breed of dog you have, and ohio pit bull definitions are so loose that this will affect more then us ..

here's some info on the constitutionality of BSL:
A BREED SPECIFIC ORDINANCE IS NOT UNCONSTITUTIONALLY VAGUE IF IT GIVES FAIR NOTICE TO A PERSON OF ORDINARY INTELLIGENCE OF WHAT IS PROHIBITED.
An ordinance is unconstitutionally vague if it encourages arbitrary and erratic law enforcement. A law regulating conduct must give adequate notice of what is prohibited, so that a person knows what is prohibited and so as not to delegate basic policy matters to policemen, judges, and juries for resolution on an ad hoc and subjective basis.[ Strict precision is not required. The language used, however, must be sufficiently clear that the person subject to its requirements does not have to guess at the meaning. A court will uphold the law if the meaning of the statute is clear to a person of ordinary intelligence.
COMMON NAMES ALONE DO NOT PROVIDE SUFFICIENT GUIDANCE TO ENFORCE BREED SPECIFIC ORDINANCES.
The breed most often named in breed specific legislation is commonly referred to as a "pit bull." I was not able to find any court that upheld legislation when that term was used alone. The problem with such ordinances is that they don't provide adequate notice of the prohibited conduct.[There is no breed known simply as a "pit bull" and therefore no means by which a person could determine whether their dog is of the regulated breed. For the same reason, such an ordinance is too subjective to the individual whim of the enforcing officer.
BREED STANDARDS PROVIDE SUFFICIENT GUIDANCE TO ENFORCE ORDINANCES AGAINST PUREBRED, OR CLOSE TO PUREBRED DOGS.
Nationwide many courts uphold breed specific ordinances when the ordinance defines them by names recognized by national dog breed registry organizations such as the American Kennel Club or the United Kennel Club. The courts note that these organizations publish specific physical characteristics to guide enforcement. These standards provided a basis for examining the physical characteristics of the dog in question and comparing them with breed standards published by the two clubs. A few courts have upheld ordinances that define the breed in question to mean "any dog which exhibits those distinguishing characteristics" that "substantially conform to the standards" established either by the American Kennel Club or United Kennel Club. Other courts have struck such ordinances down as vague because of the difficulty for even experts to determine the breeding of mixed breed dogs.

rep. fessler said there won't be hearings on oh hb 366 or oh hb 568 until after the "summer sabbatical" (i guess that's an important person's way of saying "summer vacation"  ) from the end of june through the beginning of august.
she said they're trying to get oh hb 366 passed this fall; she didn't seem to concerned w/ 568 even making it to the floor for a vote, for reasons i posted above.
last year there were over 600 bills introduced into the oh house, only 36 of them made it into law.
i'd call if you are an ohioan. my rep. dug that i called and seemed so up in arms. just keep your cool on the phone, or it might be hard to get their aid to put you on the phone with them.
if you go to this site http://www.house.state.oh.us/jsps/Representatives.jsp and type in your zip code, you'll get the name and # of your rep.
when i called rep. fessler's office, i was like "this is so-and so from this place. rep so-and-so is my elected rep, whom i voted for, and i have an issue i'd like to discuss about a bill that's in the house right now." her aid immediately put me on hold, and was back within a minute with her on the line. my input was well received, so i urge anyone who can call to do it.
