Toledo Man Claims His Dogs Aren't Vicious
var wn_last_ed_date = getLEDate("Oct24,2005,6:37 PM EST"); document.write(wn_last_ed_date);Oct 24, 2005, 06:37 PMTOLEDO -- A local dog owner says a case of mistaken identity with his pets is forcing him into court. His dogs are being compared to pit bulls, even though he says they're a completely different breed.
Shane Miller has two American Bulldogs, as he calls them, and he even has the papers to prove it. However, the Lucas County Dog Warden says the dogs are pit bulls and now Miller is facing some stiff fines and maybe a trip to jail.
"They're friendly. My daughters are out there all the time and they say they're good dogs," says one neighbor.
"My dogs ain't never attacked nobody. They ain't never attacked another animal," says Miller.
Yet he's in trouble for violating Toledo's vicious dog law, which says you can't own more than one pit bull.
Shane claims he doesn't, calling his animals American Bulldogs. He even offers up official looking documentation.
"Their weight is not the same. Their height is not the same. Their build is not the same," he says.
"They grab ahold, and hang on. They bite with as much force as they can give, and they don't let go," says Karla Hamlin, who manages the Lucas County Dog Pound.
She says the term "pit bull" is generic, applying to several different breeds of dogs, including the American Bulldog.
"That's commonly known as a pit bull. We've successfully prosecuted American Bulldogs in Maumee, and Toledo," she says.
Still, the owner feels like he and his dogs are being picked on.
"My dogs ain't never caused a problem to nobody. I've never caused a problem to nobody. I just expect the same in return," says Miller.
Dog Warden Tom Skeldon uses a ruling passed down by a Maumee judge to officially determine what is a pit bull and what isn't. It includes any dog with a well developed chest, shoulders, and legs, a large, flat head, a muscular neck, and a protruding jaw.
According to the judge, any breed with a history of fighting, a killing instinct, and an unpredictable nature, is a pit bull. Skeldon says the American Bulldog fits every category.
According to Skeldon, Toledo is the only area city to have a pit bull limit.
Shane is scheduled to be in court next month for violating the limit and for not carrying the insurance required for vicious dogs.
