About 200 municipalities ban pit bulls, but Denver, Cincinnati and Miami are the only three major cities that have done it, according to the American Canine Foundation.

At least 12 states prohibit breed specific legislation, according to the National Conference of State Legislatures.

A Denver district court ruled in 1990 pit bulls can be treated differently than other dogs because ''there is credible evidence that pit bull dog attacks are more sever and more likely to result in fatalities.'' The Colorado Legislature passed a law in 2004 that prohibited breed-specific bans, but the city of Denver sued and a judge ruled the law was an unconstitutional violation of local control.

The Alabama Supreme Court ruled in 2002 there is no genetic evidence that one breed of dog is more dangerous than another, based on breed alone.

The Ohio Supreme Court ruled in 2004 that the state's pit bull ban was unconstitutional because it denies dog owners their right to due process.
