Woman charged in her pet's attack on man, guide dog
The Hill 'n Dale man says lack of law enforcement has
allowed several attacks against him and his guide dog
during the past year.

A Hill 'n Dale woman has been charged, and her cocker spaniel
impounded, in what authorities say was the latest attack on David
Bearden and his guide dog, Isaac. The incident occurred about 11:30 a.m. Friday when a dog owned by Helga Curtis, 80, bolted from her yard on Frampton Avenue and chased Isaac, according to a Sheriff's Office report. Curtis was charged with interfering with the performance of a service dog. The incident occurred one day after Bearden learned that the State Attorney's Office will not pursue charges against the dog owners in previous attacks. One of those attacks involved Curtis and her dog. The attacks have drawn the attention of the National Federal of the Blind and the Florida Association of Guide Dog Users, which earlier this summer urged both the Sheriff's Office and the State Attorney's Office to enforce laws that protect guide dogs and their owners. Bearden, 46, is legally blind. Assistant State Attorney Pete Magrino said Monday that his office closed its investigation last week because there was insufficient evidence to prove that the previous attacks involved reckless disregard on the part of the dog owners. Magrino said it would be premature to comment on Friday's incident because paperwork had not been filed with his office as of late Monday. Bearden said four dogs, including Curtis' spaniel, have attacked him and Isaac 11 times in the past year. "They had more than enough evidence to charge them," said Bearden. "What that means to me is that the State Attorney's Office is refusing to follow the law." According to state law, anyone who injures or kills, or permits a dog they own to injure or kill a guide dog or service animal, may be charged with a misdemeanor and, if found guilty, must pay restitution. On Friday, Bearden said, he and Isaac were walking near the corner of Hill Road and Frampton Avenue in Hill 'n Dale when he heard Curtis' dog barking. In an instant, he said, the dog was charging them. "The whole event must have taken 15 to 20 seconds," said Bearden. "Isaac was running in circles, trying to get away. He's not ever supposed to do that." Bearden managed to shoo the dog away without an injury to him or Issac. In May, the pair were attacked by another dog, leaving both Bearden and Isaac, a German shepherd, with several puncture wounds. Bearden wondered Monday why it has taken so long for someone to be charged in any of the attacks. "This is the first time someone was cited," he said. "They could have stopped (the attacks) in the beginning." Lt. Charles Hinkle, the District 3 commander, said Monday the Sheriff's Office has taken the attacks seriously and has taken steps to remedy Bearden's concerns and those of others who say dogs are allowed to roam the Hill 'n Dale area illegally. Since June, Hinkle said, the sheriff's community policing unit and Hernando County Animal Control have patrolled the area east of Brooksville, apprehending seven unrestrained dogs, issuing more than 20 written warnings for unregistered dogs and giving five citations for unrestrained dogs. "We can only do what the law allows us to do," Hinkle said. "We are trying to do whatever we can for him." Curtis could not be reached for comment.

We all know how the story would've been different if the attacking dog had been an APBT. Although this forum is for APBTs, I want to post some cases in which had an APBT been involved, the case would have been "dealt" with differently.

SUTTON TO RESCUE IN DOG ATTACK

CELTIC star Chris Sutton and his wife Samantha came to the aid of a neighbour bitten by their dog yesterday. John Crawford, 73, had the top of a finger stitched back on an attack by the player's St Bernard. His wife Nan said yesterday: 'We don't blame the Suttons. It was just an accident. 'Samantha and Chris have been fantastic and did everything they could to help.' Striker Chris said: 'I'm sorry for what happened. The dog has never done anything like this before.' John, was walking two West Highland terriers past the footballer's home in Thorntonhall, near Glasgow, when the St Bernard attacked the dogs. He bit the pensioner's hand as he tried to intervene. Samantha rushed to help. She drove John home and took an injured terrier to the vet. It is recovering after major surgery. Chris and his children later visited John in hospital. Police will not be taking any action.


Again, had this been an APBT, the police WOULD be taking action. Screwed up system we have.

I agree, Its fkd up... More cocker spaniels and labs bite than any other breed... American Pit Bull Terriers are 5th from the bottom of the same list... Hmmmm... makes you wonder why peaple dont know that....
I personally have been bit my the neighbors cocker spaniel multiple times... the inHumane society didnt do anything about it... but when my big male ran through their front yard, we went to court... a few months later, my boy jumped through a window after the gas man... didnt bite him, just barked and carried on... backed him into the road.... when the man left, Bruiser was still loose, and went into the neighbors yard... and once again... we were in court... the neighbors say they are "in fear for their childrens life" they said they "taped something off TV were the familys pit bulls snapped and murdered the whole family... they think that we need to see this... they say they are afraid for us"
I rebounded with a shit load of info about how Cockers and Labs bite more and maul more than pit bulls... they should be more worried aobut the childrens granparents cocker spaniel that has bit me, than my dogs that have NEVER bit anyone!!
Even funnier, this ladys daughter is ADHD, and she has been in our home WITH HER CRAZY ASS CHILD... Bruiser never showed any aggression toward the little girl.. even after the little girl kicked the dog, punched him in the end of the nose, ran up to the dog, screamed in his face then turned and ran.... Bruiser would BARK AND RUN FROM HER!! Idiotic peaple....

YET - both of the stories also involve the elderly. I would be prone to believe that a 73 year old would have a hard time with a SB as would an 80 year young lady have a hard time chasing a cocker around. Just goes to show though that the dogs would be dead or charges pressed if it was a APBT but not of the other breeds. For some reason it seems to be acceptable for a dog to bite, sometimes almost funny all based on the breed type.

IMO....there's no better dog for an ADHD child to be around than a well bred pitbull. This is due to their pain threshold and all around loving, easy going manner. My housedogs have been around many a ADHD child and give them a HELL of a lot more compassion than I do......lol

This the same reason many therapy dogs for elderly or children are pit or pit crosses. They don't generally get upset over a poke in the eyes or a wheelchair roll and pinch their tail.

I agree 150% Crash... my Daddy was in a wheel chair for his last 12 years on this earth... so all my pits were raised around that.... Bruiser was AWESOME with Daddy... Very gentle with him, and VERY protective of him... Bruiser was good with the crazy girl... but would have enough of it, and run from her..... She would chase him screaming, and he would run faster... lol

i owned a cocker spaniel when me and my wife first met they are mean . it would bite her for no reason . if they want to band a dog they should start with them first.anyway we gave to a lady down the street it bit her and the kid next door to her .and that dog still lives there and nothing was ever done about it.but let my apbt bite some and then all hell breaks loose.i guess this just shows you that you cant judge a book by its cover.on one hand you have this little loving looking cocker that is very human aggressive. and then there is my pit that looks all mean but just wants you to come pet him for a minute.
